Our insurance company client was mired in a decade long litigation in a multi-site, multi-million dollar lawsuit seeking coverage for pollution at a number of manufacturing and waste disposal sites across the country under numerous insurance policies. We were retained after fact discovery had been closed with the client facing exposure both at the trial and appellate level on multiple issues.

Bringing a creative and energetic approach to the litigation at that juncture, we were able to refocus the litigation on those issues that provided the client with better leverage in settlement negotiations and helped formulate a new exit strategy for the client. Based upon the new approach we brought into the litigation, the client was able to achieve an extremely favorable settlement in this “bet the company” litigation.
